Terms of Use / Copyright

The International Committee for the Conservation of Mosaics ( referenced as “Foundation ICCM” ), has created and maintains the iccm-mosaics.org website in order to promote the conservation of mosaics in a broad perspective via the Internet. By using the site and its content you are agreeing to comply with and be bound by the following terms, which the Foundation ICCM may change at any time.

The iccm-mosaics.org Website Is Proprietary to the Foundation ICCM

Other than the open content images identified on the website for unrestricted downloading and the portions of the website expressly made available under a Creative Commons license (both described below), all of the text, images, marks, logomarks, and other content of the Foundation ICCM website (“Site Content”) are proprietary to the Foundation ICCM or used consistent with the owner’s permission or applicable law or regulation. The Foundation ICCM authorizes you to view, download, and print the Site Content subject to the following conditions:

  1. You must adhere to any and all additional terms or restrictions provided within individual sections of the websites relating to particular Site Content;
  2. Unless otherwise restricted, you may only do so for your own personal and noncommercial use, or for fair use as defined in the European copyright laws;
  3. Using Site Content for commercial purposes is prohibited;
  4. Using Site Content for personal websites is subject to review and approval by the Foundation ICCM provided your site takes no advertising and has no commercial sponsors, does not charge a fee for services, and does not offer any product or service for sale including your own works.   5. You may not remove any copyright, trademark, or other proprietary notices, including, without limitation, attribution information, credits, and copyright notices that have been placed in or near the Site Content by the Foundation ICCM;
  6. You may not modify the Site Content; and
  7. Any displays or printouts of the Site Content must be marked “© [insert year of display or printout] Foundation ICCM. All rights reserved.

All parties downloading, printing, or using the Site Content in any manner represent and warrant that their use will be consistent with this license and that they will not infringe or violate the rights of any other party or breach any contract with or legal duty to any other parties.

Foundation ICCM Publications Section

Foundation ICCM Publications section provides digital copies of selected Foundation ICCM and other publications, including many titles that are now out of print. All publications appear as they were originally published, with no changes made to the content or design.

Publications are available to individuals for private study, scholarship, and research purposes only; reproduction and distribution, even for non-commercial use, is prohibited. Downloading material for any commercial use is prohibited. The Foundation ICCM owns the copyright for its books; individual images and texts within these publications may also be separately protected by the copyright of their respective creators or other third parties and may require further permissions for use outside the scope of the publications in which they are contained.

The Foundation ICCM makes no warranties or indemnification relating to your use of the digital publications in the Publications Section. All parties downloading, printing, or using the content from the Publications Section represent and warrant that their use will be consistent with applicable laws including, without limitation, copyright, privacy, and publicity laws, and that they will not infringe or violate the rights of any other party. All rights not granted by the Foundation ICCM are specifically reserved. The Foundation ICCM reserves the right to withdraw any title from the Publications Section and to discontinue this section in its entirety.

Creative Commons

Some pages and portions of this website are expressly licensed under a Creative Commons (“CC”) license. Each such page or portion will be clearly marked with the specific type of CC license that applies, including a link to the text of the license. You are free to make use of these pages and portions under the terms of the applicable CC license. Read the terms of the applicable license carefully and note that individual elements of a page or portion (for example, an image from a third party) may be excluded from the CC license. Excluded items will be clearly identified.

Open Content Images

The Foundation ICCM makes available, without charge, all available digital images to which the Foundation ICCM holds the rights or that are in the public domain to be used for any purpose. No permission is required.

Some images may include people or objects for which a third party may claim rights such as trademark, copyright, privacy, or publicity rights. The Foundation ICCM does not warrant that all of the images designated for downloading are free from rights claimed by third parties. As the user, it is your responsibility to ensure that there are no restrictions based on third party rights. The Foundation ICCM assumes no liability for your use of these images if a third party makes an infringement claim.

Prior to download of the high-resolution image, the Foundation ICCM will request that you provide minimal information such as a brief explanation about your planned use of the digital images that you download. This information is governed by our Privacy Policy.

Permissions and Requests for Images and Other Site Content

Except as expressly permitted above, reproduction or redistribution of the Site Content or any portion of the Site Content is strictly prohibited without the prior written permission of the Foundation ICCM.

Blog/s

The Foundation ICCM website sometimes provide blog/s for the exchange of ideas and information.

By posting comments to a Foundation ICCM blog you agree to avoid abusive and offensive language and to refrain from posting any content that is commercial in nature, advocates for a political cause or legislation, or infringes upon any third party’s rights, including privacy, copyright, trademark, or patent. We reserve the right to delete comments and links we find to be inappropriate or offensive or not related to the topic, including, without limitation, links to commercial and political websites. We will review comments prior to posting, but we will not correct spelling, grammar, or factual errors although we may comment on them. We hope you share your thoughts with us. Please note: We may discontinue our blogs at any time. We do not have the ability to remove comments upon your request. By submitting comments, you acknowledge that they will be posted on the World Wide Web. You agree we have the right to quote from your comments in all media now known and hereinafter devised.

By posting or distributing information or material through the blog/s, you expressly abandon any proprietary rights you may have in your comments, and such information or material may be freely copied and distributed by others without your permission. You are responsible for obtaining permission from any third party owner of proprietary material, such as a copyrighted story or a news article written by another person, before you post or distribute such material. The Foundation ICCM requires you to obtain all necessary permissions before posting or distributing any content on the blog/s.

The Foundation ICCM does not warrant that use of the materials displayed in the blog/s will not infringe the rights of third parties not owned by or licensed to the Foundation ICCM. For example, some works may be under copyright by the author or the author’s heirs holding rights to these works. Such works may not be used in any form; they may not be copied or downloaded without prior permission from the holder of the underlying copyright.

Registration

Only registered Users may purchase an Foundation ICCM Membership Subscription or a conference ticket on I.C.C.M Website. Once you are registered, you have your own account (“Account”). You may register on our Website by providing the following personal information:

– your first and last name
– your e-mail address
– your username
– your password
You consent to our access to and collection of such personal information about you. You can see our Privacy Policy for more information regarding how we use the personal information that we collect from you.

Once you are registered, you may login to your Account with your username and password. You are responsible for maintaining the security of your password and Account. You are fully responsible for all activities that occur under this Account and any other actions taken in connection with this Account. You must immediately notify Foundation ICCM of any unauthorized uses of your Account or any other breaches of security. Foundation ICCM will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. During the sign-up process, you may also select the option of receiving e-mail offers from us.

Your Responsibility

  1. You agree to provide accurate and complete information about yourself and to maintain and update that information. If the information you provide is untrue, inaccurate, incomplete or not current, we reserve the right, in our sole discretion, to suspend or terminate your Account.
  2. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content.
  3. When using Foundation ICCM Website, you shall not:
    • take any action that imposes an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure;
    • interfere with the proper working of the Services we provide or any activities conducted on the Services;
    • attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services;
    • run any form of auto-responder or ‘spam’ on the Services;
    • use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the site;
    • harvest or scrape any content from the Services;
    • otherwise take any action in violation of our guidelines and policies;
    • decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Services, except to the limited extent applicable laws specifically prohibit such restriction;
    • modify, translate, or otherwise create derivative works of any part of the Services;
    • copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder;
    • act in such a way that the Services are damaged, interrupted or made less efficient;
    • manipulate or abuse the Services, or act in such a way that it creates an unreasonable strain on the Services.

Memberships

Foundation ICCM Memberships are non refundable. Login details, which include usernames and passwords, must not be shared. If misuse is detected your subscription may be terminated. Exclusive Membership Content which utilize a unique url must not be shared. Unique urls must not be made available publicly such as via an externally accessible page. Members found to be sharing their unique access to I.C.C.M website will be contacted and potentially have their subscription terminated.

Payment System

We use a third-party payment processor, CartaSi X-Pay , (the “Payment Processor”), to bill Users. Each User can pay the fees due via our Website. The processing of payments shall be subject to the terms, conditions and privacy policies of the Payment Processor in addition to I.C.C.M’s Terms Of Use. We are not responsible for error or delays by the Payment Processor. By placing an order for the purchase of one of the Foundation ICCM Memberships or Conference Tickets, you agree to pay us, through the Payment Processor, all charges at the prices stated for the applicable order. You further authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payment using that selected Payment Method. Τhe terms of your payment will depend on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method.

Links to Third Party Websites Are Not Endorsements

The Foundation ICCM websites contain links to third party websites. The linked sites are not under the control of the Foundation ICCM, and the Foundation ICCM is not responsible for the contents of any linked site. The Foundation ICCM provides these links as a convenience only, and a link does not imply endorsement of, sponsorship of, or affiliation with the linked site by the Foundation ICCM.

Warranty Disclaimer and Limitation of Liability

The Foundation ICCM makes no representation of any kind regarding the Site Content or any portion thereof. All Site Content is provided in “AS IS” condition, and the Foundation ICCM expressly disclaims any and all warranties of merchantability or fitness for a particular use.

Digital Millennium Copyright Act Compliance

Applicable Law and Jurisdiction

The Foundation ICCM website (excluding links to websites operated by others) are controlled and operated by the Foundation ICCM from its offices in Sabina, Italy. Although the Foundation ICCM has made no effort to publish the Foundation ICCM site elsewhere, they are accessible in all E.U. countries and in other countries due to their presence on the World Wide Web. As each of these countries have laws which may differ from those of Italy and from each other, and as you and the Foundation ICCM both benefit from establishing a predictable legal environment in which to publish, access and use the Foundation ICCM website, by publishing, accessing, and/or using the Foundation ICCM website you agree that all matters arising from or relating to the use and operation of the Foundation ICCM website will be governed by the Italian and European Uniton laws, without regard to its conflict of laws principles. You agree that all claims you may have arising from or relating to the operation or use of the Foundation ICCM website will be heard and resolved in the courts of Sabina, Italy. You consent to personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts. If you choose to access the Foundation ICCM website from locations other than Sabina, Italy, you will be responsible for compliance with all local laws of such other locations.

Indemnity

You agree to indemnify, defend, and hold the Foundation ICCM harmless from all claims, causes of action, allegations, costs, expenses, fees (including reasonable attorneys’ fees), judgments, liabilities, losses and damages arising from or relating to your use of or operation of the Foundation ICCM website.

Linking to Us

We thank you for your interest in linking to our site. The Foundation ICCM grants users permission to link to particular pages or sections of its website (deep linking) by using the actual webpage address or some other word or phrase; the Foundation ICCM logo may not be used for this purpose. Please be advised that the Foundation ICCM does not guarantee that this will remain a persistent link over time.

Using the Foundation ICCM Logo

The Foundation ICCM’s online logo mark may be copied and displayed for the sole purpose of linking to the Foundation ICCM’s website from the websites operated by other non-profit educational and cultural organizations and institutions, including libraries and museums.
